The local system has its own divorce law. Reforms described as “no-fault divorce” in England and Wales do not automatically apply here. Separating couples should therefore obtain advice based on the local legal framework and their individual circumstances.

The legal basis for divorce

A divorce petition must rely on a legally recognised fact under the Matrimonial Causes framework. The appropriate basis depends on conduct, separation period, consent and circumstances. The wording should be accurate and proportionate because unnecessary hostility can make related issues harder to resolve.

Separation before divorce

Some couples need immediate advice about housing, finances, children, safety or benefits before any divorce petition. Practical arrangements can be recorded by agreement, but informal understandings may not create finality. Consider what requires short-term stability and what requires a binding court order.

Children are a separate issue

Divorce does not itself decide where children live or how contact operates. Child arrangements should remain welfare-focused. If agreement is not safe or possible, separate Children Order proceedings may be needed.

Finances and property

The family home, savings, pensions, debts, income and business interests may all be relevant. Transferring property or accepting a payment without full disclosure and advice can have lasting consequences. A divorce alone does not necessarily bring financial claims to an end.

Disclosure and negotiation

Both parties should provide honest financial information where financial relief is being considered. Negotiation, solicitor correspondence or mediation may help, but agreement should be converted into an appropriate formal order where finality is intended.

Safety and urgent protection

Where there is domestic abuse, coercive control, stalking or risk to a child, safety planning and protective orders may take priority over ordinary negotiation. Keep evidence safely and seek immediate help where danger is present.
